Terms of Service

Welcome to ChessAtlas. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ANKT SERVICES ("Company," "we," "us," or "our") governing your access to and use of the ChessAtlas platform, including our website, applications, APIs, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. Please read them carefully.

IMPORTANT: By creating an account, subscribing to any plan, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Acceptance of Terms

1.1 Agreement to Terms

By creating an account, accessing, or using ChessAtlas in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms, guidelines, or rules that may be posted on the Service from time to time.

1.2 Capacity to Contract

You represent and warrant that you have the legal capacity and authority to enter into these Terms. If you are accepting these Terms on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind that entity to these Terms.

1.3 Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by: (i) posting the updated Terms on our website with a revised "Last Updated" date; (ii) sending you an email to your registered address at least 30 days before the changes take effect; or (iii) displaying a prominent notice within the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Definitions

For the purposes of these Terms, the following definitions apply:

  • "Account" means the registered user account you create to access the Service.
  • "Content" means all text, graphics, images, audio, video, data, and other materials that may be accessed through the Service.
  • "Course" means a chess opening repertoire or training program created by the Company or Users.
  • "Library Content" means courses, training materials, and content available in the ChessAtlas Library created by the Company.
  • "Service" means the ChessAtlas platform, including the website, web applications, mobile applications, APIs, and all related services.
  • "Subscription" means a paid plan that provides access to premium features of the Service.
  • "User Content" means any content you create, upload, or otherwise make available through the Service.
  • "Variation" means a sequence of chess moves representing a line in your repertoire, used as a unit for plan limits.

3. Service Description

3.1 Platform Overview

ChessAtlas is a chess repertoire training platform that enables users to:

  • Create, study, and practice chess opening repertoires
  • Access a library of professionally curated courses created by ChessAtlas
  • Import and analyze games from Lichess and Chess.com
  • Train with spaced repetition algorithms (SM-2/FSRS) to improve move memorization
  • Track learning progress, streaks, and identify repertoire deviations
  • Earn experience points and track gamification statistics

3.2 Subscription Plans

ChessAtlas offers the following subscription tiers with different feature sets:

Free Plan

  • Up to 100 variations in your repertoire
  • 1 linked chess account (Lichess or Chess.com)
  • Basic training features
  • Access to free library courses

Plus Plan - $4.99/month or $49.99/year

  • Up to 1,000 variations in your repertoire
  • Up to 3 linked chess accounts
  • Game synchronization from Lichess and Chess.com
  • Access to all library courses

Premium Plan - $9.99/month or $99.99/year

  • Unlimited variations in your repertoire
  • Unlimited linked chess accounts
  • Game synchronization from Lichess and Chess.com
  • Full access to all library courses
  • Priority support

4. Account Registration

4.1 Registration Requirements

To use certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information as requested in the registration form
  • Maintain and promptly update your account information to keep it accurate and current
  • Maintain the security and confidentiality of your account credentials, including your password
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access, use, or security breach of your account

4.2 Age Requirements

You must be at least 13 years old to create an account and use the Service. If you are between 13 and 18 years old, you represent that you have your parent's or legal guardian's permission to use the Service.

4.3 One Account Per Person

Each user may only maintain one account. You may not create multiple accounts to circumvent plan limitations, avoid suspension, or for any other purpose.

5. Subscription and Billing

5.1 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. We do not store your full credit card numbers, CVV codes, or banking details on our servers.

5.2 Automatic Renewal

YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW at the end of each billing period unless you cancel before the renewal date. We will send you a reminder email at least 7 days before each renewal date.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. In accordance with French law (Loi Châtel) and the EU Digital Services Act, you can cancel using the same method you used to subscribe. Cancellation takes effect at the end of your current billing period.

5.4 Refunds

Refund requests are handled on a case-by-case basis. If you believe you are entitled to a refund, please contact support@chessatlas.net within 14 days of your purchase.

6. Free Trial

6.1 Trial Eligibility

We may offer a free trial period for new subscribers. Free trials are available only to new users who have not previously subscribed to a paid plan or used a free trial. Only one free trial is permitted per person, household, or payment method.

6.2 Trial Terms

During the free trial period, you will have access to all features of the subscribed plan. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

7. Intellectual Property Rights

7.1 Company Intellectual Property

The Service, including its original content, features, functionality, and underlying technology, is owned by ANKT SERVICES and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 License to Library Content

Subject to your compliance with these Terms and payment of applicable fees, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to access and use Library Content solely for your personal chess training and education. This license does not include the right to copy, reproduce, distribute, sell, or use Library Content for commercial purposes.

7.3 Trademarks

"ChessAtlas," our logo, and other ChessAtlas trademarks are trademarks or registered trademarks of ANKT SERVICES. You may not use these trademarks without our prior written consent.

8. User-Generated Content

8.1 Ownership of User Content

You retain ownership of original creative content you create on ChessAtlas, specifically:

  • Original annotations, notes, and comments you write
  • Your creative selection and arrangement of moves into repertoires
  • Original analysis and explanations you create

Important clarification: Games imported from third-party platforms (Lichess, Chess.com) may be subject to the terms of those platforms. Individual chess moves and positions are not copyrightable.

8.2 Data Export and Portability

You have the right to export your User Content at any time in a machine-readable format (PGN for chess data). We will not sell, license, or monetize your User Content without your explicit consent.

9. Acceptable Use Policy

9.1 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable local, national, or international law or regulation
  • Infringing upon the intellectual property rights, privacy rights, or other rights of others
  • Using automated systems (bots, scrapers) to access the Service without our permission
  • Attempting to gain unauthorized access to other user accounts or computer systems
  • Interfering with or disrupting the Service
  • Uploading or transmitting malicious code or viruses
  • Creating multiple accounts to circumvent plan limitations

10. Third-Party Services

10.1 Integrated Services

The Service integrates with the following third-party services:

  • Stripe: Payment processing
  • Google OAuth: Authentication service
  • Lichess API: Game import from Lichess.org
  • Chess.com API: Game import from Chess.com

11. Service Level Agreement

11.1 Availability Target

We target 99.5% monthly uptime for the Service. This target excludes: (i) scheduled maintenance communicated at least 48 hours in advance; (ii) emergency maintenance; (iii) circumstances beyond our reasonable control.

11.2 Support

Technical support is available via email at support@chessatlas.net. We aim to respond within 5 business days for Free plan users and within 2 business days for Premium plan users.

12. Copyright Policy

12.1 Copyright Takedown Notices

If you believe that content on the Service infringes your copyright, please send a notice to legal@chessatlas.net containing: a signature of the copyright owner, identification of the copyrighted work, identification of the infringing material, your contact information, and a statement of good faith belief.

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting support or using the account deletion feature in your settings. Upon termination, your access to the Service will be immediately revoked and your User Content will be deleted in accordance with our data retention policy.

13.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, for any reason, including if you breach any provision of these Terms, engage in harmful conduct, or fail to pay subscription fees.

14. Disclaimers

14.1 Service Provided 'As Is'

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

14.2 No Guarantee of Results

Chess training results may vary. We do not guarantee any specific improvement in your chess rating, performance, or skill level as a result of using the Service.

15. Limitation of Liability

15.1 Liability Cap

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED EUROS (€100).

15.2 Exceptions

Nothing in these Terms shall limit or exclude our liability for: (i) death or personal injury caused by our negligence; (ii) fraud; (iii) any other liability that cannot be excluded by applicable law. If you are a consumer in the European Union, nothing in these Terms affects your statutory rights.

16. Indemnification

You agree to indemnify, defend, and hold harmless ANKT SERVICES and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any third-party right; (iv) any claim that your User Content caused damage to a third party.

17. Dispute Resolution

17.1 Informal Resolution

Before initiating any legal proceedings, you agree to contact us at support@chessatlas.net and attempt to resolve the dispute informally.

17.2 Mediation

In accordance with Articles L.611-1 et seq. of the French Consumer Code, if you are a consumer and a dispute cannot be resolved informally, you have the right to submit the dispute to a consumer mediator free of charge.

18. Governing Law

18.1 Applicable Law

These Terms and any disputes arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of France.

18.2 EU Consumer Rights

If you are a consumer residing in the European Union, you retain the benefit of any mandatory provisions of the consumer protection laws of your country of residence.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChessAtlas regarding the Service and supersede all prior agreements.

19.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force and effect.
